የመንግስት ስልጣን ምንጭ የህዝብ ፈቃድ መሆኑ ማለት የመንግስት ህጋዊነትና ስልጣን የሚመነጨው ከህዝቡ ፍላጎትና ስምምነት ነው። ህዝቡ በመምረጥ ወይም በሌሎች መንገዶች ስልጣኑን ለተወካዮቹ ይሰጣል፣ እነሱም በህዝብ ስም ይገዛሉ። ይህ መርህ የህዝብ ሉዓላዊነት በመባል ይታወቃል። (የተጠቀሰው "768" የኢትዮጵያ ህገ መንግስት አንቀጽ 8(1)ን ሊያመለክት ይችላል።)
